United Kingdom on 23 June 2016 - The public decision was to leave the EU.

The important points that arise on the effect of this decision on IP rights are as below:

  • The outcome of this decision has no effect on the UK national IP Rights nor on all the registrations that were obtained through the United Kingdom Intellectual Property Office (UKIPO)
  • The European Patent Convention (EPC) and The European Patent Office (EPO) are not an EU institution, and UK’s membership is independent, therefore; Patents obtained via EPC/EPO will remain active.
  • The Unitary Patent and the Unified Patent Court which is an EU initiative and participation is dependent upon being a member of the EU, will be effected, once the withdrawal from the EU is complete.
  • Registered trademarks and designs in the EU, will remain unaffected for the time being. However new provisions will be set up to give these marks a continuing effect in the UK.
