Iraq has made a significant move toward modernizing its trademark registration process by introducing an online portal. This marks the end of the old manual system, aiming to streamline procedures, reduce delays, and enhance the efficiency of trademark applications. By aligning with international standards, Iraq seeks to improve transparency and accessibility for all applicants.
Key Changes in the Trademark Registration Process
The new online portal is now the mandatory platform for all trademark filings. To submit an application, applicants must:
- Create an account
- Authenticate their details
- Submit applications and track their status digitally
The system also requires that all necessary documents (e.g., proof of use, classification details) be uploaded electronically, and all payments be made online—eliminating the need for physical transactions and paperwork.
Important Updates You Need to Know:
- New Classification System:
Iraq has adopted the 11-2017 edition of the Nice Classification. The old classification system is no longer in use. - No Sub-Classes:
Sub-classifications are no longer accepted in trademark applications. - Application Deadline:
Applications must comply with the new classification rules. Failure to do so will result in rejection. - Logo Submission Requirements:
- All trademarks with text must include both Arabic and English versions, with the Arabic text being more prominent and placed above the English text.
- The logo background must be removed, and the image should be 720×720 pixels in size, submitted in PNG format.
- Renewal Applications:
Trademarks due for renewal must adhere to the updated classification system. Class descriptions must be amended to avoid rejection.
How to Stay Compliant and Protect Your Trademarks
To align with these regulatory changes, trademark holders should act swiftly:
- Review existing trademarks: Ensure classifications are up to date.
- Update renewal applications: Make sure they comply with the new system.
- Re-file unregistered trademarks: Prepare for re-filing under the new system, pending further clarification.
