Required Documents:
Power of Attorney (POA): simply signed

Process:

  1. The registration process takes 15-18 months to be completed
  2. A single application could be filed for multiple classes
  3. The application will be examined by the TMO within a period of 10 to 12 months. After the end of the examination period, the TMO will issue a decision to either:
  4. Accept the application, the publication fees should be settled and the mark will be issued in the official gazette.
  5. Conditionally accept the application, the TMO gives the applicant 30 days from the official notification date to appeal or amend the application as requested, otherwise the application will be rejected."
  6. Any interested third party can oppose the publication of the trademark application within 60 days from the date of publication in the official gazette. The applicant has 60 days from date of official notification to file a reply to the opposition, otherwise the application will be considered withdrawn. The TMO sets a hearing within 8 months from filing the reply to try to reach conciliation between both parties
  7. The certificate of registration will be issued within 1 month from the date of settlement of registration fees.
  8. The TMO publishes the trademark certificate in the official gazette for informative purposes only; No one can oppose the said publication
  9. The trademark's registration is valid for 10 Gregorian years, starting from the filing date, and renewable for similar consecutive periods.

Required Documents:

  1. Power of attorney (PoA) – simply signed
  2. Deed of Assignment (DoA) – simply signed
  3. Patent full specifications in English or Arabic or French
  4. Certified copy of the priority document.

Process:

  1. The patent registration process takes around 24 months.
  2. After filing the application, it is examined as to form and substantive requirements.
  3. A patent application is published in the AlMuwassafat quarterly gazette published by the Institute National de la Normalization et de la Propriete Industrielle (INNORPI), together with a summary of the contents thereof. The grant of a patent is also published. There are no provisions in the law as to appealing the decisions of the Registrar.
  4. A patent is protected for 20 years from the filing date.
  5. An annuity fee must be paid starting the filing date. A 6-month grace period is given for a late annuity.
  6. EPO granted Patent can be directly validated in Tunisia with no examination requirements.

Required Documents:

  1. A summarized description of the design.
  2. Applicant info (name and address).
  3. Power of attorney (PoA): Simply signed.
  4. Deed of assignment if the applicant is not the designer.
  5. Translation to Arabic of all documents and descriptions is required at time of filing
  6. Copy of the commercial certificate document is required.

Process:

  1. One application can cover only one design.
  2. The process from filing to issuance of certificate is for a period of 1 to 2 years.
  3. No annuities.
  4. The design registration is valid for 5, 10 or 15 years.
  5. Renewal is allowed for the extension of a maximum 15 years overall duration.
