Process:

  1. The registration process takes 3-4 months to be completed.
  2. A single application could be filed for multiple classes.
  3. "The application will be examined by the TMO within a period of 1 to 3 months. After the end of the examination period, the TMO will issue a decision to either:
  4. Accept the application, the publication fees should be settled and the mark will be issued in the official gazette.
  5. Conditionally accept the application, the TMO gives the applicant 60 days from the official notification date to comply or amend the application as requested, otherwise the application will be rejected.
  6. Any interested third party can oppose the publication of the trademark application within 60 days from the date of publication in the official gazette. The applicant has 60 days from date of official notification to file a reply to the opposition, otherwise the application will be considered withdrawn.
  7. The certificate of registration will be issued within 1 month from the date of settlement of registration fees.
  8. The TMO publishes the trademark certificate in the official gazette for informative purposes only; No one can oppose the said publication.
  9. The trademark's registration is valid for 10 Gregorian years, starting from the filing date, and renewable for similar consecutive periods.

Required Documents:

  1. Power of attorney (PoA) – simply signed.
  2. Deed of Assignment (DoA) – notarized or legalized by both parties, along with its English or French translation.
  3. Patent full specifications in French or Arabic
  4. Certified copy of the priority document.

Process:

  1. The patent registration process takes 2-3 years.
  2. A preliminary search report accompanied by an opinion on patentability to appreciate the novelty, the inventive step, and the industrial application of your invention, is prepared by a patent examiner specialist in the technical field of the invention. The report cites the prior art it establishes a list of patent inventions and documents related to your invention and have been made available to the public before the filing date of your application for a patent.
  3. If accepted, the patent will be published and any interested third party can oppose the said application within 2 months from the date of publication.
  4. If the application passes the publication period successfully, the certificate of registration will be issued after payment the official fees.
  5. A patent is protected for 20 years from the filing date.
  6. Annuities should be settled after acceptance and grant of the patent application on the anniversary of the international filing date or national filing date or validation date.
  7. A 6-month grace period is granted to settle the annuities subject to late penalty fees.
  8. EPO granted Patent can be directly validated in Morocco with no examination requirements after payment of the official fees.

Required Documents:

  1. A summarized description of the design.
  2. Applicant info (name and address).
  3. Power of attorney (PoA): Simply signed.
  4. Deed of assignment if the applicant is not the designer.
  5. Translation to Arabic of all documents and descriptions is required at time of filing
  6. Copy of the commercial certificate document is required.

Process:

  1. One application can cover up to 50 designs (additional charges to be paid for each additional design).
  2. The process from filing to issuance of certificate is for a period of 1 to 2 years.
  3. No annuities.
  4. The design registration is valid for 5 years.
  5. Renewal is allowed for three consecutive periods of 5 years.
