Process:

  1. The registration process takes 3-4 months to be completed.
  2. A separate application should be filed for each class.
  3. The application will be examined by the TMO within a period of 1 week. After the end of the examination period, the TMO will issue a decision to either:
  4. Accept the application, the publication fees should be settled within 30 days from the official notification date, otherwise the application will be considered withdrawn.
  5. Amend the application, the applicant has 10 days from the official notification date to amend the mark as requested, otherwise the application will be rejected. However, the applicant may appeal the said decision within a period of 60 days from the official notification date.
  6. Reject the application, you may appeal the decision within a period of 60 days from the official notification date, otherwise the application would be considered withdrawn."
  7. Any interested third party can oppose the publication of the trademark application within 60 days from the date of publication. The applicant has 30 days from the official notification date to file a reply to the opposition, otherwise the application will be considered withdrawn.
  8. The applicant has 30 days from the end of publication period date to settle the registration fees, otherwise the application will be considered withdrawn.
  9. The certificate of registration will be issued within 1 week from the date of settlement of registration fees
  10. The trademark's registration is valid for 10 Hijri years which is equivalent to 9.8 Gregorian years, starting from the filing date, and renewable for similar consecutive periods.

Required Documents:

  1. Power of attorney (PoA) – Apostilled/legalized
  2. Application as filed (in Arabic) + Drawings (AR)
  3. Certified copy of the priority document.

Process:

  1. The patent registration process takes around 4-5 years.
  2. Once filed, the application will be formally examined to check if all the required documents were submitted. If not, the Examiner will give the applicant 3 months from the official notification date to fulfill all requirements, otherwise the application will be considered withdrawn.
  3. When formally accepted, the applicant will have 3 months from the official notification date to settle the substantive examination fees and publication fees, otherwise the application will lapse.
  4. The examination will be substantially examined 3 times (when necessary)
  5. After acceptance, the applicant has to settle the grant fees to publish the application in the official gazette within 3 months from the official notification date; otherwise, the application will lapse.
  6. The applicant may file an extension of time requesting an additional 60 days from the end of the original deadline.
  7. If the application passes the publication period successfully, the certificate of registration will be issued.
  8. The protection period of a patent is 20 years, from the filing date of the PCT application, or the national patent application based on the Paris Convention.
  9. Annuity fees should be paid from the second year, starting the PCT filing date (during the period of 1st of January till the end of March yearly).

Required Documents:

  1. A summarized description of the design.
  2. Applicant info (name and address).
  3. Power of attorney (PoA): Original should be notarized and legalized.
  4. Deed of assignment if the applicant is not the designer.
  5. Translation to Arabic of all documents and descriptions is required at time of filing
  6. Copy of the commercial certificate document is required.

Process:

  1. One application can cover multiple designs.
  2. The process from filing to issuance of certificate is for a period of 6 months to 1 year.
  3. The design registration is valid for 10 years.
  4. Annuity payments are settled at the beginning of each year, between January and March.
