New Decree on the Validity of Powers of Attorney – Kuwait

The Kuwaiti authorities have issued Decree No. 147 of 2025 concerning the validity of powers of attorney (POAs).

Under this new decree, the validity period of all POAs is now limited to five (5) years from the date of notarization before the notary public, whether the notarization took place inside or outside Kuwait. Once this five-year period expires, a new power of attorney must be issued to remain legally effective.

Additionally, POAs that were established before the enforcement of this decree-law will remain valid for two (2) years from its effective date.

This decree aims to enhance legal certainty and ensure consistency in the regulation and use of powers of attorney in Kuwait.
