Yemen: Implementation of the 12th Edition of the Nice Classification
As of October 10, 2024, the Trademark Office in Sanaa has officially adopted the 12th Edition of the Nice Classification. This update brings Yemen’s classification of goods and services in line with global standards, enhancing the consistency and efficiency of trademark protection.
Here are two important points to keep in mind:
- Single-Class Application System: The Yemeni Trademark Office requires that each application only cover up to four items of goods or services. This single-class system aims to simplify the application process.
- Restrictions on Certain Products: The new classification does not allow for the registration of trademarks related to alcoholic beverages (Class 33), specific alcoholic products (Class 32), and pork (Class 29). These restrictions reflect local regulations and cultural norms.
Additionally, the process for publishing accepted trademarks has moved to an electronic format. Trademark publications will now be available online through the Trademark Office’s system, rather than in the official gazette, “Al-Tijarah.” Currently, access to these publications is limited to registered agents at the Trademark Office.
This electronic shift also applies to other processes such as recordals, oppositions, and counter-statements, which must now be filed electronically instead of on paper.
These changes demonstrate Yemen’s commitment to improving trademark processes and fostering a more efficient intellectual property environment.
