Trademark Office Update

The Trademark Office (TMO) in Yemen has recently implemented a new procedural requirement for the filing and processing of trademark applications in Class 05, which covers pharmaceuticals and medical supplies.

 

This new requirement replaces the TMO’s previous policy, which mandated submission of a license from the Supreme Authority for Medicines and Medical Supplies as a prerequisite for processing Class 05 applications. While limited exceptions were previously granted by the TMO, the new procedure is now being strictly enforced for all Class 05 applications before they can proceed to registration.

 

Under the new rule, the TMO will no longer process Class 05 applications through the normal registration procedure unless the applicant submits a special declaration confirming the following:

 

  • The trademark is being registered solely for protection purposes; and
  • The mark will not be used within Yemen.

 

This declaration must be prepared by the Legal Department of the Ministry of Industry and Trade in Aden and is subject to an official fee of YR 30,000 (approximately USD 30).

 

It is important to note that this declaration is purely procedural. Any commercial use of goods in Class 05 within Yemen remains strictly subject to a separate and specific license issued by the Supreme Authority for Medicines and Medical Supplies.
