As part of the United Arab Emirates’s ‘Projects of the 50’, a series of developmental and economic projects that aim to accelerate the UAE’s development and transform it into a comprehensive hub in all sectors. The UAE has published a new Federal Law No. 36 of 2021 regarding trademarks and geographical indications, which will enter into force in January 2, 2022. The new law will replace the Federal Law No. 37 of 1992. Implementing regulations are still in process and will be shared once published.

The new law addresses include several updates to issues both administrative, and substantive. The ability to file a multi-class application, and the ability to officially file documents including priority documents at a later time are some examples of administrative updates. On a substantive front, the new law takes into account famous marks explicitly and defines them and further takes into account prior use, and case law.

the new law will come into effect on 2-January-2021, we will be providing a more comprehensive assessment before then, so keep an eye out for our further articles!
